Terms of service

These terms are an agreement between you and The Software Tub Ltd ("we", "us"), the company that provides TouchBase. By creating an account or using the app, you agree to them. Please read them, especially the section on what TouchBase is not.
What TouchBase does
You choose a daily check-in time and one or more emergency contacts. Each day you check in by pressing the button, opening the app or tapping a reminder. If you don't check in within the allowed time after your check-in time, we send a text to your emergency contacts so someone knows to check on you.
What TouchBase is not
TouchBase is not an emergency service. It does not contact the police, ambulance or any other emergency service, and nobody monitors your check-ins. If you or someone else is in danger or needs urgent help, call 999.
TouchBase depends on things outside our control, including your phone, its battery and settings, your internet connection, notifications being allowed, mobile networks, and the companies that deliver our notifications and texts. So we cannot promise that:
- every reminder or alert text will be sent, or arrive on time;
- your contacts will see an alert, or be able to act on it;
- the service will always be available.
Please don't rely on TouchBase as your only way of getting help. It works best alongside other arrangements, such as regular contact with family, friends or neighbours.
Your part
- Keep your check-in time and contacts up to date, and make sure each contact has a main number that can receive texts.
- Only add people who are happy to be your emergency contact. Tell them what TouchBase is and what they should do if they get an alert. The app can open a message for you to send them.
- Keep the app installed, allow notifications, and keep your phone charged and connected.
- Keep your password private. You're responsible for what happens on your account.
- Don't misuse TouchBase: no false or misleading contact details, no using it to harass anyone, and no attempts to disrupt or break into the service.
Alert texts
Every alert is a text message that costs us money to send. To keep TouchBase free, we limit how many alert texts we send for each account each month. If that limit is reached, further alerts that month may not be sent. We may change the limit, and we'll tell you in the app or by email if we reduce it.
Who can use TouchBase
You must be 16 or over and live in the UK. Alert texts are sent to UK mobile numbers.
Price
TouchBase is currently free. If we introduce paid features in future, we'll explain them clearly first, and you'll never be charged without agreeing to it.
Changes and availability
We keep improving TouchBase, so features may change. We may need to pause the service for maintenance, and we'll try to keep that short. If we ever decide to close TouchBase, we'll give you reasonable notice first, so you can make other arrangements.
Our responsibility to you
We provide TouchBase with reasonable care and skill. Because of the limits described above, and as far as the law allows, we are not responsible for loss or harm caused by a reminder or alert that was not sent, was delayed, or was not acted on, or by the service being unavailable.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit. Your legal rights as a consumer are not affected.
Ending your account
You can stop using TouchBase and delete your account at any time; see deleting your account. We may suspend or close an account that breaks these terms. Once an account is closed, reminders and alerts stop.

Our privacy policy explains what we collect and how we use it.
Changes to these terms
We may update these terms. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using TouchBase after that, the new terms apply.
The law that applies
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
